The rulings below have been issued by the United States Customs and Border Protection (CBP) agency and represent a collection of legal decisions and advance rulings made over the past decade and more. The listings hereunder include only those relating to trade under AGOA preference and which seek clarity from CBP on issues around a correct origin determination for (preferential) trade purposes, preferential AGOA status and tariff classification. Rulings obtained from and issued by CBP are binding on traders and customs officials and are instructive when similar questions arise at a later stage.
The publication of these rulings further assist the international trade community in helping clarify sometimes complex issues pertaining to classification and origin and can give traders a clearer understanding on how their goods will be treated upon importation into the United States.
A ruling to guide the interpretation of the law around classification, origin status, AGOA eligibility and related matters may be obtained by exporters and importers (individual, company, association or other entity or group) with a direct and demonstrable interest in the questions presented. These procedures are set out in the U.S. legislation (at 19 C.F.R. Part 177).
